1. Acceptance of these terms
By accessing or using nodespark.ai (the "Site"), you agree to these Terms of Use. If you do not agree with them, please do not use the Site.
2. Who we are
The Site is operated by Private Entrepreneur Hryhorii Ostapenko (TIN 3153220235), registered in Sumy, Ukraine, doing business as NodeSpark ("NodeSpark", "we", "us"). You can reach us at gregory@nodespark.ai or elina@nodespark.ai.
3. Using the Site
You may browse the Site, read its content, contact us, and book calls for your own business purposes. You agree not to:
- attempt to disrupt, overload, or gain unauthorized access to the Site or its infrastructure;
- use automated tools to scrape or harvest content or data from the Site at abusive volumes;
- use the contact form or booking calendar to send spam, malware, or unlawful content;
- misrepresent your identity or affiliation when contacting us.
4. Intellectual property
The Site's design, text, graphics, animations, and code are owned by NodeSpark and protected by copyright. You may not reproduce or reuse them commercially without our written permission, except for brief quotations with attribution.
Third-party names and logos shown on the Site — including the tools in our technology stack (n8n, Make, OpenAI, Claude, Instantly, HubSpot, and others) — are trademarks of their respective owners. They are shown for identification purposes only, and their appearance does not imply endorsement of NodeSpark by those parties.
5. Case studies and metrics
The case studies, client references, and figures on this Site (such as automations deployed or hours saved) describe real projects and our genuine experience. They are provided for information only: every business is different, and past results are not a promise of the results you will get. The animated workflow diagrams are simplified illustrations of the underlying systems, not exact technical documentation.
6. Services and pricing on the Site
Descriptions of our services and the pricing tiers shown on the pricing page are indicative and do not constitute a binding offer. Actual scope, deliverables, fees, and terms for any engagement are agreed in a separate written agreement or quote between you and NodeSpark, which — where it conflicts with these terms — takes precedence for that engagement.
7. Third-party links and embedded services
The Site links to and embeds services operated by third parties, including Cal.com (booking), Formspree (contact form), and LinkedIn. Your use of those services is governed by their own terms and privacy policies, and we are not responsible for their content or practices. See our Privacy Policy for details on how data flows through them.
8. No warranties
The Site and its content are provided "as is" and "as available", without warranties of any kind, express or implied, including fitness for a particular purpose, accuracy, or uninterrupted availability. Content on the Site is general information, not professional, legal, or financial advice.
9. Limitation of liability
To the maximum extent permitted by applicable law, NodeSpark shall not be liable for any indirect, incidental, or consequential damages arising from your use of, or inability to use, the Site or its content. Nothing in these terms excludes liability that cannot be excluded under applicable law, including mandatory consumer-protection rights in your country of residence.
10. Governing law
These terms are governed by the laws of Ukraine. Any dispute arising from the use of the Site shall be resolved by the competent courts of Ukraine, unless mandatory law in your country of residence provides you with the right to bring proceedings elsewhere.
11. Changes to these terms
We may update these terms from time to time. The current version is always available on this page, with the "Last updated" date above. Continued use of the Site after changes take effect constitutes acceptance of the updated terms.
